Deed Poll - Schedule

1. Power and Water

Power and Water Corporation

2. Northern Territory Resident

A person who has lived continuously in the Northern Territory for at least 12 months immediately before the date of Application, evidenced by proof of residency.

Note: Students temporarily living away for boarding school or study will fall within the above definition if their principal place of residence remains in the Northern Territory.

3. Maximum Scholarship Period

Undergraduate study - up to 4 years.

Postgraduate study - up to 2 years.

4. Territory Work Period

You must live and work in the Northern Territory for a total period equivalent to the duration of the Scholarship Period.

5. Scholarship Funding

$10,000 (exc. GST) per year.

6. Payment Schedule

Instalments of the Scholarship Funding will be paid annually following the receipt of evidence of enrolment in the Degree.

7. Employment Opportunities

Where available, Power and Water may offer you vacation employment or work experience.

8. Reporting Obligations

Evidence	Example	Due

Deed Poll Terms and Conditions

Defined Terms and Interpretation

1. In this Deed, unless a contrary intention appears:
   1. Application means the application made in accordance with this document;
   2. Applicant, You (or similar), Maximum Scholarship Period, Territory Work Period, Scholarship Funding, Payment Schedule, Employment Opportunities and Reporting Obligations are defined in the Schedule at the front of this Document; and
   3. Power and Water, Applicant, Degree, Higher Education Provider, Scholarship Period, Scholarship Commencement Date, Scholarship Completion Date, Questions and Bank Account are defined in the Application Form at the front of this Document.

Term

2. This Deed commences on the date you are notified in writing that your Application is successful.
3. Unless terminated earlier, this Deed ends when the Territory Work Period obligation is completed.
4. For the avoidance of doubt, this Deed will have no effect unless you are notified in writing that your Application is successful.

Obligation to Complete the Degree

5. You agree to undertake and complete the Degree on a full-time basis unless Power and Water agrees in writing to part-time study due to exceptional circumstances.
6. You agree to meet all academic and non-academic requirements of the Degree and your higher education provider to the best of your ability.

Territory Work Period

7. You agree to complete your Territory Work Period obligation within 10 years of the Scholarship Completion Date unless Power and Water agrees otherwise in writing.

Payment of Scholarship Funding by Power and Water

8. You acknowledge that Power and Water will make payments of the Scholarship Funding to the Bank Account in accordance with the Payment Schedule.
9. You acknowledge that Power and Water may withhold payment if you have not met an obligation under this Deed.

Release from Obligations

10. You may seek to be released from carrying out your obligations under this Deed, in full or in part, including for compassionate reasons (a release).
11. You acknowledge that Power and Water may approve or decline the release request acting reasonably and may impose conditions.

Employment Opportunities

12. You acknowledge that Power and Water is not obligated to offer Employment Opportunities, and will do so subject to availability.

Repayment Obligations

13. Unless you have been provided a release, you agree to repay to Power and Water the Scholarship Funding if you breach your obligations under this Deed or this Deed is terminated.
14. If you partly meet your Territory Work Period obligation, Power and Water may require only pro-rata repayment.
15. You agree to the repayment in accordance with an invoice provided by Power and Water providing for full repayment within 30 days of the invoice.
16. If you cannot make the payment if full, you may seek Power and Water's agreement to a repayment schedule, which will not be unreasonably withheld, provided that you substantiate financial hardship or other exceptional circumstances.
17. If you do not pay an instalment of the repayment within 7 days of that instalment becoming due, Power and Water may give you a notice requiring immediate payment of the instalment. If you do not pay that instalment within 10 days of the date on the notice, the whole of the remaining amount of the repayment will become immediately due and Power and Water may recover that amount as a debt due to Power and Water.

Your reporting and notification obligations

18. You must provide information required under the Reporting Obligations by the specified due date.
19. You must notify Power and Water within 28 days of any change to your:
    • name, contact details or Bank Account;
    • Higher Education Provider, Degree enrolment status, or study load affecting eligibility or completion time; or
    • circumstances that are likely to affect your obligations under this Deed.

Media

20. You agree not to participate in publications or broadcasts connected to the Scholarship without Power and Water's prior written approval.
21. You agree to cooperate with Power and Water in publicising the Scholarship.

General Matters

22. This Deed is governed by the law of the Northern Territory of Australia, and you must submit to the jurisdiction of the courts of the Northern Territory at Darwin unless otherwise agreed.
23. Power and Water may terminate this Deed, after giving you at least 14 days' written notice, an opportunity to respond, and considering any response, if it reasonably believes that you:
    • have breached this Deed;
    • have provided false or misleading information in your application, related evidence or reporting for term of the Scholarship; or
    • have become bankrupt.
24. On termination Power and Water will not make any further payments and may seek repayment of the Scholarship Funding in accordance with clauses 13 to 17.
25. The expiry or termination of this Deed will not affect clauses intended to survive.
26. Changes to this Deed must be agreed in writing.
27. Nothing in this Deed creates an employment, agency or partnership relationship.
28. You consent to Power and Water using and sharing your information in accordance with the Information Act 2002 (NT) for:
    • publicity, evaluation, administration, research or service delivery; or
    • reporting or answering questions including from Power and Water's Board, Ministers or regulators.
